June 2026. “This arbitration is pending. The Firm and representatives deny the allegations and intends to vigorously defend the matter. The representatives believe the recommendations were suitable and made in good faith based on the client’s objectives, financial circumstances, tax considerations, and information available at the time. No finding of liability has been made. The transactions involved a 1031 exchange reviewed by the client’s CPA and qualified intermediary. The representative believes the recommendations were suitable and designed to meet the client’s diversification, income, and tax-deferral objectives. No finding of liability has been made.” The customer is seeking $350,000 in damages, and the case is currently pending. The complaint was regarding real estate security losses, and it took place while he was registered with MSC – BD, LLC.
Pursuant to FINRA Rules, member firms are responsible for supervising a broker’s activities during the time the broker is registered with the firm. Therefore, MSC – BD, LLC may be liable for investment or other losses suffered by Alfred Dinicola Jr.’s customers.
