Whipple has been the subject of three customer complaints between 2005 and 2020, one of which was denied, according to his CRD report:
- June 2020. “Multi-claimant case, alleging unsuitability, misrepresentation, and lack of due diligence relative to UDF IV.” The case is currently pending and was regarding real estate securities.
- April 2017. “Clients allege unsuitability for investments that they purchased in 2012.” The customer sought $99,000 in damages and the case was settled for $37,500. The complaint was regarding direct investments and common and preferred stocks.
Pursuant to FINRA Rules, member firms are responsible for supervising a broker’s activities during the time the broker is registered with the firm. Therefore, Kalos Capital, Inc. may be liable for investment or other losses suffered by Whipple’s customers.
