March 2026. “Claimant alleges the financial professional recommended unsuitable alternative investments.” The customer is seeking $5,000 in damages, and the case is currently pending. The complaint was regarding direct investment losses, and it took place while he was registered with Kestra Investment Services, LLC.
February 2026. “Claimants allege that between September 2020 and April 2023, the Representative exercised discretionary authority in their account to purchase an exchange-traded note. They further allege that the recommendation was not suitable for their investment objectives and that the position was held longer than they believe was appropriate. Claimants also assert that certain statements made regarding the investment’s characteristics and performance were inaccurate.” The case is currently pending. The complaint was regarding exchange-traded products, and it took place while he was registered with Kestra Investment Services, LLC.
August 2024. “Claimant alleges Byrd misrepresented the investment and made unsuitable recommendations.” The customer sought $5,000 in damages, and the case was settled for $3,300,000. The complaint was regarding exchange-traded notes, and it took place while he was registered with Kestra Investment Services, LLC.
February 2024. “Claimants allege Mr. Byrd recommended the sale of unsuitable investments.” The customer sought $5,000 in damages, and the case was settled for $65,000. The complaint was regarding direct investment losses, and it took place while he was registered with Kestra Investment Services, LLC.
August 2023. “Claimant alleges Byrd made unsuitable recommendations and the claimant’s account was overconcentrated.” The customer sought $5,000 in damages, and the case was settled for $705,000. The complaint was regarding exchange-traded notes, and it took place while he was registered with Kestra Investment Services, LLC.
April 2023. “Claimants allege Mr. Byrd recommended the sale of unsuitable investments.” The customer sought $445,000 in damages, and the case was settled for $210,000. The complaint was regarding direct investment losses, and it took place while he was registered with Kestra Investment Services, LLC.
Pursuant to FINRA Rules, member firms are responsible for supervising a broker’s activities during the time the broker is registered with the firm. Therefore, Kestra Investment Services, LLC may be liable for investment or other losses suffered by Markus Byrd’s customers.
